3-Year Extended Warranty Terms & Conditions

  1. General. These Terms and Conditions apply to the 3-year extended warranty (the “Warranty”) provided by Dead River Company, LLC (the “Company”) to you. The Warranty applies to new propane heating systems and related equipment, components and parts installed by the Company (the “System”). The Warranty does not cover any other item, including, without limitation, (a) any pre-existing parts, equipment, or appliances; and (b) any parts, equipment or appliances that are not provided by the Company at the time of System installation. All other warranties are hereby disclaimed.
  2. Term. The Warranty remains in effect for three years from date of installation of the System.
  3. Eligibility; Termination. Eligibility for the Warranty requires that you: (a) regularly perform routine maintenance on the System; and (b) purchase your entire propane supply from Company on an automatic delivery basis at all times during the term of the Warranty. If the System requires or supports the use of antifreeze, then you must maintain the antifreeze in the System in compliance with the manufacturer’s specifications at your expense. The Warranty automatically terminates without refund if you fail to have the Company supply all of your heating fuel, discontinue doing business with the Company, or if anyone other than the Company renders service to the System. The Company may also terminate the Warranty, without refund, if after providing prior notice to you, any of your payments on your account(s) with the Company are delinquent.
  4. Warranty Service Calls. Service calls after 5 p.m. on weekdays, or on weekends or holidays, because of System failure resulting in no heat or no domestic hot water, are covered by the Warranty. All other service calls deemed necessary by you after 5pm on weekdays or on weekends or holidays will be billed to you at current labor rates even if qualifying parts are covered by the Warranty.
  5. Replacement Parts; No Other Warranties. The Company reserves the right to repair or replace the System or any covered equipment, component or parts of the System that fails under normal operating conditions. When equipment, components or parts of a System are replaced, the Company will use a comparable model.
  6. Termination; Modification. If any payment is not received by the Company within the 30-day payment terms, the Company can cancel the Warranty and all work performed by the Company will be billed to you at the Company’s then-current rates. The Company reserves the right to amend the Warranty from time to time as necessary.
  7. What is covered. The Warranty covers a single System installed by the Company, including maintenance, repair and replacement of that System, and most heating components for propane gas central heating appliances, propane space heaters, or propane-fired standalone water heaters.
  8. What is not covered.The Warranty does not cover any of the following:
    1. Parts or labor required as a result of abnormal conditions, such as water damage, ice damage, fire, flood, freezing, lightning strikes or other acts of God, power interruptions, insufficient fuel when your account is not on automatic delivery, payments owed to the Company by you for propane are in arrears, or insufficient water.
    2. Service required as a result of your failure to: (1) perform routine maintenance on the System, (2) replace fuses or thermostat batteries, (3) reset circuit breakers, (4) set or program thermostats properly, or (4) turn on the emergency switch.
    3. Correcting propane flow problems related to the outside storage of propane, or venting issues due to the buildup of ice or snow causing system performance issues.
    4. Any pre-existing equipment, component or part at the time that the System is installed by the Company.
    5. Humidifiers, electronic air cleaners, air conditioning equipment and A/C coils.
    6. Handling or removal of asbestos or equipment containing asbestos.
    7. Labor for repairing or replacing uncovered parts and/or systems.
    8. Any part or equipment that was not installed by the Company.
    9. Fuel tanks and lines that are not owned by the Company.
    10. Specialty controls not installed by the Company.
    11. General plumbing, piping, or household wiring.
    12. Chimney, power venters and draft inducers.
    13. WIFI thermostats.
  9. Exclusions.The Company has no responsibility for your or any third-party’s actions resulting in:
    1. Water leaks and/or piping defects in floors, ceilings and side walls that affect the operation of the System or causes System damage. You are responsible for providing the Company with access to all concealed or hidden components of the System, and for any and all repairs or replacements that arise out of the Company’s need to have access to those components (including, for example, walls, partitions, floors, ceilings, chimneys, entryways, etc.).
    2. Consequential or special damages or losses of any kind; any harm from work not performed by the Company; any damage caused by burner or equipment failure; unavoidable delays; abuse or neglect by you or any-third party; or any harm from causes beyond the Company’s control.
    3. Damages to the System that has been maintained, serviced, or had modifications, additions, or any change of any related equipment, component or part other than as provided by the Company after the time of the initial installation of the System by the Company.
    4. Damage, including environmental, arising out of any leakage from any propane gas lines, propane tanks or any other part of your propane system.
    5. Repairs, upgrades, maintenance, replacements, or substitutions to the System required by any change in applicable law, rule or regulation.
    6. Damages resulting from any tampering with or misuse of the System (or any related equipment, component or part).
    7. Parts, materials or components which are discontinued or obsolete.
  10. Warranty Transfer to New Owners. At the Company’s discretion, the Warranty may be transferable upon the sale of your property where the System is located and may require inspection of the System by the Company with the new owner.
